Trading Terms and Conditions
Application of Conditions
The Customer agrees that all goods supplied by the Company and/or services rendered by the Company
are subject to the conditions contained herein and such other conditions which may appear on the
Tax or Commercial Invoice and/or Waybill of the Company. No variation or alteration of such
conditions shall be effective unless reduced to writing and signed by a duly authorised director
or manager of the Company. No indulgence granted by the Company shall constitute a waiver of any
of the Company’s rights.

Risk
Risk in the goods shall pass to the Customer on delivery, but ownership shall remain vested in
the Company until the purchase price has been paid in full. The Company reserves the right to
inform the end-user or the owner of the premises in which the goods are situated of its claim
to ownership.
Guarantees, Warranties, Damaged Goods, and Incorrect Deliveries
- The Customer shall not have any claim against ICM Industries for any loss or damage howsoever incurred arising out of or in connection with the Goods supplied or to be supplied.
- Claims under the Manufacturer’s guarantee or for damaged goods/incorrect deliveries must be supported by original commercial documents (where applicable).
- Claims for incorrect deliveries or damaged goods will only be considered if made in writing within 5 (five) days of delivery.
- Any warranty as to quality or fitness is excluded. The Company shall not be under any liability in respect of defects or any injury, damage or loss resulting from such defects or misuse.
- The Company shall not be liable for consequential losses.
- All ICM Pumps have a 1 (Three) months Warranty. The warranty period is measured from date of sale/receipt as proven by documents (invoice, POD etc.).
- The warranty excludes reinstallation costs after repair or replacement.
- All warranty claims must be submitted to and processed by ICM Industries.
- Warranty covers defects in material/workmanship and excludes negligence, misapplication, improper installation, inappropriate maintenance and oversized pump sizes.
- The Company may void warranty where external conditions or incorrect application caused failure.
- Examples not covered: top-feeding wells without motor flow sleeve, water hammer, surges, lightning, improper controls, phase failures, frequent restarting, incorrect installation, non-professional installation, failure to follow manuals, wear/tear/corrosion.
- The Company may warrant/replace only the defective part or component.
- Normal wear parts excluded: pump shaft; seals, capacitors, pressure switches.
- Do not dismantle without written consent of ICM Industries. If dismantled without permission/presence, warranty is null and void.
Service Center Terms and Conditions
- Strip and quote fees apply to items received at the Service Center.
- Strip and quote fees lapse upon approval of service quotation / warranty conditions met.
- Quotations are valid for 30 (thirty) days.
- No items will be released until payment and/or formal order is received.
- Items not authorised/collected within 30 days may be discarded as scrap with no claim against the Company.
- Customer must request faulty parts return with repair (not standard practice).
- Reports are based on information received and inspection/analysis of items.
- No installation/on-site support services are provided.
- Service and repair work has a 3 (three) month warranty from service invoice date.
Borehole and Vertical Pump Installation Precautions
Our borehole and vertical pumps are designed for vertical installation only.
Horizontal installation compromises functionality and can void warranties.
- Install vertically for proper water intake and efficient pumping.
- Secure properly to prevent vibration damage using recommended brackets/hardware.
- Provide clearance for maintenance and to avoid intake/discharge obstruction.
